Changes to Tarion to protect new home buyers

Chris Jaglowitz at the Ontario Condo Law Blog posted an article last month detailing some changes to Tarion’s rules on adjustments for taxes and development charges. As he notes, the existing rules allow a municipality to adjust for taxes based on estimates without requiring them to return any amount overcharged when the assessment is finally released. The changes to Tarion would prevent them from adjusting for any item for which they have not actually been charged. As Chris notes, there is currently a public consultation happening on this rule.
